How Does a Stamp Duty Refund Work?

When you buy a new home before selling your previous one, you pay a 3% surcharge on top of the standard SDLT rates. HMRC's logic is that you temporarily own two properties.

If you sell your previous main residence within 3 years of buying the new one, you can claim a full refund of that 3% surcharge. The refund must be claimed within 12 months of selling the previous property.
